Terms of Service

1. Agreement and Scope

These Terms govern your access to and use of Nasisms, including dashboard access, SMS campaign tools, sender ID management, contact management, API usage, wallet top-ups, and reporting features. By creating an account or using the Service, you agree to these Terms.

2. Eligibility and Account Responsibilities

You must provide accurate registration details and keep your credentials secure. You are responsible for all actions performed through your account, including activity by team members, API keys, and integrations connected to your workspace.

3. Acceptable Use of SMS Services

You may only send messages to recipients who have consented or where messaging is otherwise lawful. You must not use the Service for spam, phishing, fraud, harassment, illegal promotions, deceptive content, or any content that violates telecom regulations, privacy laws, or operator rules.

You are responsible for message content, recipient lists, campaign targeting, and honoring opt-out or do-not-contact requests.

4. Sender IDs and Compliance

Sender IDs may require approval by the platform team and/or mobile network operators. Approval can be denied, delayed, suspended, or revoked if compliance documents are incomplete, inaccurate, or inconsistent with campaign use. You must only use Sender IDs for authorized brands or entities.

5. Wallet, Billing, and Pricing

Messaging is billed per segment and recipient according to your active pricing. Wallet balances are prepaid. Charges apply when messages are submitted for processing and may vary by route, destination, and encoding. Fees paid to operators or payment processors are non-refundable except where required by law.

6. Delivery and Service Availability

Delivery outcomes (queued, sent, delivered, failed) depend on network operators, handset availability, and destination conditions. We do not guarantee uninterrupted availability, exact delivery timing, or universal delivery success rates.

7. Data and Intellectual Property

You retain ownership of your data and campaign content. You grant us a limited right to process your data solely to provide the Service, including routing messages, generating logs, and compliance monitoring. All platform software, branding, and documentation remain our intellectual property.

8. Suspension and Termination

We may suspend or terminate access if we reasonably suspect abuse, non-payment, security risk, legal/regulatory violations, or actions that could harm network reputation. You may stop using the Service at any time.

9. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or campaign losses arising from message delays, failures, filtering, or service interruptions.

10. Changes to Terms

We may update these Terms from time to time. Updated versions will be posted on this page with a revised effective date. Continued use of the Service after updates means you accept the revised Terms.
